1 On May 28, 1962 the county attorney of Sequoyah County filed an information in the district court of said county, charging the plaintiff in error, Ray C. Harvell, with the crime of "first degree murder", in that he shot and killed one Samuel R. Pleasant on May 21, 1962. The plaintiff in error, hereinafter referred to as the defendant, was tried to a jury, and convicted of manslaughter in the first degree, the jury fixing his penalty at sixteen years in the State Penitentiary. Judgment was rendered on September 24, 1962, and petition in error with casemade was duly filed in this Court.
